And in case the said second parly shall fail to make the payments aforesaid, ant? each of them, punctually upon the strict terms and times above limited, and likewise to perform and complete all andeachofSz.z*AA- agreements and stipulations aforesaid, strictly and literally, without any failure or default, including thepaym-nt of all lawful taxes and assessments on said land, before the said taxes shall become delinquent by law, then this contract, so far as it may bind said first parly, shall become utterly null and void, and all rights and interests hereby created, or then existing in favor of the second party, or derived from .2.-.z-;..c.-......shall utterly cease and determine, and the right of possession and all equitable and legal interests in the premises hereby contracted shall revert to and revest in said first party without any declaration of forfeiture or act of re-entry, or any other act of said first party to be performed, and without any right of said second parly of reclamation or compensation for moneys paid, or service performed, as abso~ lutely, fully and perfectly as if this contract had never been made. And said first party shall have the right immediately, upon the failure of the party of the second pari, to comply with each and all the stipulations of this contract to enter upon the land, aforesaid, and lake immediate possession thereof, together with the improvements and appurtenances thereunto belonging. And the said parly of the second part covenants and agrees that. 7.Z...7. .will surrender unto the said parly of the first part, the said land and appurtenances, without delay or hindrance, and no court shall relieve the party of the second part from a failure to comply strictly and literally with this contract. And it is further stipulated that no assignment of the premises shall be valid unless the same shall be endorsed hereon, or permanently at/ached hereto, and approved by said first party (for which purpose this contract must be sent to Close Bros. & Co., Agents, by mail or otherwise, qnd their approval endorsed thereon in writing), and that no agreements or conditions, or relations between the second party and S.L.JZ—.assignee, or any other person acquiring title or interest prom or through 2^_i==_=k-! shall preclude the first party from the right to convey the premises to the second party or..- ^.z..A..A. assigns, on the surrender of this agreement and the payment of the unpaid portion of the purchase money which may be due to the first party.
